The municipal code for DUI in Overland Park is 12.04.030.  The Overland Park Municipal Court can prosecute arrests for First DUI or Second DUI.  If the arrest is the third or more, the case will be sent to the Johnson County District Court.

To convict you of DUI, the prosecutor must prove beyond a reasonable doubt that you operated or attempted to operate a vehicle while intoxicated.  An Overland Park DUI Attorney will review the evidence in your case to determine whether all of the elements of a Overland Park DUI are present.  If not, you may have a legal or factual defense to your case.

OVERLAND PARK DOMESTIC BATTERY

A domestic battery case in Overland Park can get real serious - real fast.  Even if the incident was a one time occurrence, it is important to have an Overland Park Attorney who aggressively represents clients to get the best outcome possible.

Domestic violence cases cannot be dropped once the charges are filed.  Many people do not know that it is up to the prosecutor to drop charges - the alleged victim cannot do it.  Often, prosecutors do not drop charges unless the case falls apart.  You and your attorney should be very careful when speaking with a prosecutor about the facts of a case.

Assault, battery, and domestic battery codes in Overland Park are found under 11.08.010, 11.08.020, 11.08.021 respectively.

OVERLAND PARK DRUG CHARGES

Fighting drug charges requires a comprehensive understanding of the constitution because many of the defense theories depend on application of the Fourth Amendment to an illegal search or the Fifth Amendment upon your right to silence.  As one of few attorneys who have argued these issues at the highest levels, Attorney Adam D. Stolte is well suited to take your case.

OVERLAND PARK THEFT CHARGES

The City of Overland Park takes theft cases seriously.  In addition to the possibility of jail time, the court often prohibits the offender from returning to the store in shoplifting cases.  In some circumstances, the court may prohibit the offender from visiting any retail stores within the city limits.  Theft, 11.12.120, is a class A misdemeanor.
