Effectively Defending Against Kansas Felony Charges

Representing people charged with felonies requires more than just a willingness to go to trial. Any attorney can say that. An aggressive pretrial motion strategy is the key to positive outcomes in felony cases. Simply drafting a relevant, lengthy pretrial motion can be a critical component to a case. First and foremost, it lets prosecutors know you are serious about fighting your case. That could result in a plea offer too good to pass up. That's why every felony case at Stolte Law, LLC gets thoroughly reviewed for any possible motions.

Sentencing in Felony Cases

In Kansas, the sentence for a felony case depends on two factors:

  • The defendant's criminal history score
  • The severity level of the crime

The criminal history score ranges from A to I, with a score of "A" having the most prior convictions. The severity of non-drug offenses ranges from 1 to 10 with "1" being the most severe. Drug crimes range from 1 to 5.

To determine the length and type of sentence in most criminal cases, the Kansas Sentencing Guidelines has been charted. The location on the chart, and the sentence in the case, depends on the intersection of the criminal history score and the severity level of the offense. In off-grid felonies, such as DUI or murder, the terms of the sentence are found in the crime-specific statute.
